Judge Reverses Lawsuit Award to Former TXU

DALLAS -- The former TXU plans to appeal a decision overturning a jury award in a dispute over wind energy.

Tom Kleckner is a spokesman for the former TXU's power-generating division, Luminant. He said the Dallas-based company plans to appeal.

TXU claimed Florida-based FPL Energy had failed to meet a contract requiring it to supply certain amounts of energy from three wind farms in West Texas.

The wind farms claimed TXU deliberately blocked delivery of their energy by clogging high-voltage transmission lines.

TXU sought $46 million in damages and interest.

In June, a jury awarded TXU $8.9 million.

But a judge Friday sided with FPL lawyers who claimed TXU hadn't suffered losses because it didn't buy or produce electricity to make up for energy that the wind farms didn't deliver.

TXU was bought last year by private investors and is now called Energy Future Holdings.
