A judge has declared a mistrial in the case of a Bryan man accused of killing his neighbor.

After about ten hours of deliberating the fate of Lee Earnest Hamilton, 53, the jury remained deadlocked Thursday.

Hamilton pleaded not guilty to beating Robert Jordan, 44, to death with a shotgun.

Hamilton allegedly tried to shoot Jordan, but when the shotgun didn't go off, he instead beat him with the gun.

Hamilton could have faced up to life in prison.

Thankfully the accused will be RE-TRIED and not just "get off" as stated in an earlier comment. It only takes one person on a jury to cause a mistrial - someone who doesn't want to bear the burden of convicting someone and putting them away. Wonder how this person would feel if the accused was set free and took the life of another person.

Who will the DA's office blame for this loss? 2 murder trials in 3 months that have been slamdunk cases and have ended in mistrials.

Probably not a good idea to second guess the "man on the ground". I suspect that there was some evidence of a struggle and the guy claimed self defense. And if there was a history of threats against the killer and the DA wasn't willing to allow the jury to consider Manslaughter, it might have been tough for some of them not to sympathize.

It can be deadlocked if there wasnt efficient evidence. You have to look at the location and other circumstances.

Now a person kills someone and gets off! Wow, what a wonderful world we live in. What does that tell our youth? Its a shame the proof is there, a person took somone's life and walks! Wow!
