Andrea Yates Could Get Retrial

The Texas Court of Criminal Appeals Wednesday refused to reconsider a lower ruling that overturned the capital murder convictions of Andrea Yates.

A prosecutor says the case of the Houston woman, who in 2001 drowned her five children in a bathtub, will be retried, or a plea bargain will be considered.

Jurors rejected an insanity defense for Yates. She was found guilty of two capital murder charges for three of the deaths.

Yates was sentenced to life in prison and is jailed at a psychiatric prison in East Texas.

In January, the First Court of Appeals in Houston overturned the convictions due to false testimony from a forensic psychiatrist.

Yates works in the commissary of the Skyview Unit, where she helps with inventory and stocking items. Prison officials say she's caused no problems during her time as an inmate.
