He's accused of driving more than three hours to have sex with a child. A day later, he's free.

Plano minister Joe Barron, 52, didn't spend a lot of time in Bryan, he was arrested as soon as he arrived. He also didn't spend much time in the Brazos County jail where he easily made bond.

Since Barron's bond was set at $7,000 last week, many have questioned why the bond was set so low. However, when it comes to understanding how judges set bonds District Attorney Bill Turner says there are several things that are considered.

The first, is the safety of the community. One must ask if the person arrested poses a threat.

Next up, what are the ties the defendant has to the area? Prosecutors say a person with a strong connection to the community is much more likely to show up for court.

Also, the safety of the victims plays a big role.

"Sometimes you may be talking about different criminal history because that may affect the bond schedule. Sometimes the number of counts can affect that decision as well," Turner said.

Out of the 12 men who have been arrested by Bryan police for online solicitation of a minor the bonds have varied greatly.

You have one hit with a $40,000 bond and another given a $60,000 bond. Then there are last week's arrests. Christopher Kazmierski was given a $9,000 bond and and Joe Barron was released on a $7,000 bond.

So why the discrepancies?

"Online solicitation is a fairly new offense and I think that as you see more and more of these cases filed you'll see a more consistent approach to it," Turner said.

The charge of online solicitation of a minor has only been on the books since mid 2005. That's why some say the variance in the bonds is so great. Turner says they are trying to work out the kinks.

"I know currently within the last day or two they( JP's) have decided they need to meet and see if they can get a more uniform bond schedule for these types of crimes," Turner said.

Turner says there isn't a certain dollar range now when setting a bond for a charge of online solicitation of a minor.

However, he did add that justices of the peace are cautioned to not be unusually cruel or high in what they set. The defense could then turn around and file a motion for habeas corpus: in other words a motion to get them some relief.

News 3 spoke to Judge Vera Lara-Hooge who says she set the bonds for both Kazmierski and Barron.

She says the bonds at this stage are not meant to punish the defendants, and that she took into account past criminal histories and probable cause statements.

Lara-Hooge says Barron had no criminal past. A search of Kazmierski's background though shows a theft charge from 2006.

Somehow I missed the defense; The fact that he pointed out that safety of the victims should be a consideration seemed almost like a subtle criticism the low bonds(without making the judge mad, of course; remember what happened when his ADA locked up a guy that a judge tried to release without bond? Davis is STILL on the rag about that one). About the only hint of a defense was the suggestion that " justices of the peace are cautioned to not be unusually cruel or high in what they set.".

jack is not an issue , he is not even a real person , it is obvious to see that jack either the good reverand himself or a dear friend , since our judges felt it necesary to turn this man out for litttle more than a traffic fine. then our beloved DA gets in the paper and on tv to defend the action of our judges . so good people jack is truly not even worth responding to . lets focus on the problem of our justice system here in aggieland .remeber at the polls what judges are doing , AND YES , THEY THINK THESE PEOPLE VOTE , AND THEY PR BOND THEM OR SET VERY LOW BONDS..MAYBE WE NEED A CHANGE IN LOTS OF AREAS, OF OUR JUSTICE SYSTEM.

The sad thing is that you could hold up a local convenience store with a water pistol and get more time in the long run and definitely a higher bond amount than a potential child molester. Just because someone is in an elected office or has initials after their name (indicating hopefully higher education) doesn't mean they have any common sense (judges, D.A.'s J.P.'s, etc.) Child molesters are consistently hit with short sentences and low bonds - has been happening for years and is a particular pet peeve of mine. And like another person commented - this probably wasn't this guy's first time to TRY - this was only the first time he got caught - no telling what all he has done in the past. And does anyone REALLY think that video camera sitting next to his computer and box of condoms was meant as a present for the girl? Give me a break! Kudos to the COPS who busted this jerk. Too bad our judges can't do their part in keeping this trash off our streets.

Jack: You're an idiot. How much more evidence do you need? He was caught IN THE ACT of trying to meet a 13 year old child. He had CONDOMS with him. There were more contacts on his cell phone. Even if he has neurological problems he does not need to be around children. Personally, I'm glad you're moving. How soon can we expect the big event? I'd like to watch. We "right wing facists" don't need the likes of you around here. Have a nice trip. By the way, do you know any children that have been molested? If you did, it might change your stupid opinion.

Per the Texas Constitution, the JP does not need a legal background, they are supposed to be a common sense judge, although some use no common sense whatsoever. Even though a law degree is not required, I would definitely prefer it. I wouldn't blame the race factor solely on Judge Hooge, how about we see how low Judge Quintero sets bonds for Hispanic offenders, wow, what he'll do for votes!!!

Jack-yes we shouldn't be so quick to judge, he obviously is a sick individual that needs help but look at the case against a local Bryan architect, who was found with illicit photos on his computer he had taken of underaged young women some that were taken at his home during a strip poker party. His bond was set at $5000 and he was released the same day. He walked freely around our town for almost two years before his case finally went to trial. Why should it take so long when you have so much incriminating evidence against someone before it goes to trial. He served 120 days in jail. Hardly enough as far as I'm concerned. He is registered as a sex offender which I see as the only gratification in this entire ordeal. What a shame that we always hear how our government is doing so much to crack down on sexual predators but yet we slap them on the wrist and let them walk. What a sad and unsafe world we live in today.

On the Money. Concerned Citizen and John. JP bad call. I checked the booking records on one of these guys. He was in Jail for about 3 hours total. We had a double murderer kill someone in the area a few weeks back he was out on a Low Bond also. If the Judge does not think he is likely to do this again she is making a dangerous decision. I hope they do not get their hands on someones children. Maybe if this had happened to one of the judges children it would have been different.

And as I said before, there are other things than money which can be just as if not more effective. GPS ankle bracelets are a big one for peds, since if they hang out at the park or around the schools, they know they'll get to play monopoly; "Go To Jail. Go DIrectly To Jail, Do Not Pass Go..."

Jack-he had several other chats going with other females, possibly children. How does a 52 year old man get entrapped by agreeing to have sex with a 13 year old girl? Please-move from this area as fast as you can so the IQ level will raise a few points!! If you need help packing, I know a former housekeeper that is probably looking to make some extra cash.....

As I understand it, a bail bondsman charges a fee of 10% of the bail to get them out of jail, if I am not mistaken. If that is in fact the case a suspect with a $7,000 bond gets out for $700 if he goes through a bail bondsman. If there is someone that knows more about this kind of thing than I do, please correct me if my numbers are wrong. $700 is not very much money to assure that someone appears in court to answer to charges that might send them to prison for a very long time. On election day we need to send a message to the judges that are endangering our community by setting low bonds.

The bond should be high enough, and conditions on his release (which weren't mentioned; it could be that the judge said that even looking at a keyboard or a kid gets him tossed back in the slammer with loss of bond) should be sufficient to make him decide that it's a REAL BAD idea to either run or commit another crime... And it does have to be taylored to the individual circumstances; a million bucks would keep most of us behind bars (even with bailbondsmen), while somebody like Ken Lay, were he still alive, could pay it out of his pocket change.

The arrested above are looking at some long time if convicted. With the low bond amount it would not surprise me if the run south of the Boarder. One thing is for sure they have extra money to do it. Based on what the DA said. I cannot see why the JP would do this Two times. We had a rapist run off and it took America's most wanted and years to get him back to Bryan.

You people are a bunch of facist right wing holier than thou arts! you do not know all of the facts in this case yet you want to hang this guy without even giving him a trial. You need to try and find out more info about these matters before you get the lynch mob together, how do you know if this guy has nurological disorders or some other condition that would affect his judgement or not! Who knows this whole thing may just have been an entrapment, and this guy wouldn't normally do this. Get the facts before you hang people, this is the reason I am moving from this area to one that has people who are more understanding and intelligent!

How did a house cleaner get almost as high a bond for taking some jewelry. I place the safety of my children much higher then anything I have. Shame on the Judge is being nice. Does this JP have any legal background? How could it happen two times with the same judge? I seen judges like this on fox news O'Reilly factor. I now understand why so many crimes are done In Brazos county by people out on multiple bonds and PR-Bonds.

Personally, I wouldn't trust this guy as far as I could toss him, but it is INNOCENT until proven guilty. The bond is just a monitary promise to appear at court, not a command to stay in jail. I would be upset if he was found guilty and given a light sentence. But a low bond should not even be an issue.

Let them fill for a Motion of habeas corpus for relief on a high bond. It takes Time and money to get a Attorney. It takes alot of time to get a Court date weeks and months. It takes Only few hrs to bond out on a low bond amount. If the charge is trying to have SEX with a Child under 14. Bad call 2X JP.

Judge lara Hooge needs find a new job. She a danger to the community and the people of Texas with her decisions. Does she have a law degree? My Family will not vote for her again. Can the County judge remove her from office? Maybe the County can stop her from setting anymore bonds. About 10% down and you bond out. $700.00 and $900.00 and you walk out of Jail for trying to have sex with a child under 14. It cost me almost $100.00 to out gas in my car.

JUst like the other people said in other comments. bryan/ brazos county doesnt do their jobs. I would have to strongly agree with them. Anyone who says they do are died wrong or they work for the court house and deffending them cause they are one of them who isnt doing their job!

Shame on you judge! A %7,000 bond on any felony is unacceptable, much less one where someone is accused of coming into our community to prey on our kids. If Judge Lara-Hooge likes this crap going on in her backyard, then perhaps it's time for her to move to one of the big cities where it happens all the time. Vote her, and any other weak JP out of office!!!
