Another Brazos County courthouse battle between Judge Rick Davis and the district attorney's office appears to be heating up.

This time it involves how a grand jury was picked and why its term was extended.

Brazos County District Attorney Bill Turner filed a motion Monday to have both his office and Judge Davis recused from any investigation being undertaken by the 272nd District Court grand jury.

In his motion, Turner says Davis secretly extended the grand jury's term which expired at the end of September.

He also questions how the grand jury was chosen, saying Davis abandoned the usual random selection process for one that allows grand jurors to be nominated.

Turner states this process resulted in the selection of a grand jury foreperson who works for one of Davis' campaign contributors.

The motion goes on to reiterate past differences between Davis and Turner which has already resulted in Davis being recused from one trial.
