A Burleson County Grand Jury cleared Caldwell Police Officer Cougan Hignight and Police Chief Paul D. Lilly of the shooting death of a suspected armed robber.

Last week, 36-year-old Louis Avrin, of Caldwell, was killed after police say he robbed a Brookshire Brothers store, then led officers on a high speed chase.

Police say Avrin wrecked his vehicle, then fired and hit Officer Hignight, who was chasing him.

Police say they've dealt with Avrin before, for what they classify as "mental issues."

News 3 has obtained video from the officer involved shooting.

This video shows alleged armed robber Louis Avrin firing at Caldwell police officers and the policemen fatally firing back.

YOU PEOPLE THAT CRITIZE THESE OFFICERS NEED TO GET A LIFE. IF SOMEONE WAS SHOOTING AT YOUR FAMILY WOULD YOU SHOOT BACK. THESE GUYS PUT THEIR SELF ON THE LINE EVERYDAY AND THEY ARE PROFESSIONALY TRAINED TO USE THEIR WEAPONS AND ALSO TRAINED AS TO WHEN THE WEAPONS NEED TO BE USED. AS FOR THE PEOPLE SUPPORTING HPD LOOK THEY MAY NOT USE THEIR WEAPONS AS MUCH BUT ONCE A WEEK YOU HEAR ABOUT A OFFICER DYING ON THE STREETS IN HOUSTON. GET A LIFE HE WAS ONLY DOING HIS JOB. I SAY THAT WAS NOTHING BUT A JOB WELL DONE. HE SHOWED GREAT TACTICS AND SKILLS. ITS NOT LIKE HE JUST WALKED UP TO HIM AND PUT A BULLET IN HIS HEAD. THE MAN SHOT MANY TIMES AND GOT WHAT HE DESERVED. Before anyone starts judging what this officer did they first need to realize how each and every day this officer puts his life on the line not only to provide for his family but to do what he loves to do most which is to protect and serve. In my opinion I feel he did the right thing and anytime any officer feels he needs to second guess wheather or not he is doing the right thing just remember the old saying that "It is better to be judged by 12 then to be carried by 6". (We love you Coug and our hearts and prayers are with you)

When a criminal shoots @ a police officer, he / she is ASKING to be killed, and most times that is what happends. I cant believe all the BS about the officer just doing what would most certainly come natural to anyone that is being shot at! I COMMEND THIS GALANT OFFICER! Job well done!

'hpd would of apprehended him with no gun fire' HPD has some kind of magic gadget that would have stopped HIM from shooting first??? Darn, lets make that standard equipment for ALL cops! Or did you just mean that the HPD wouldn't have had to shoot him because their training makes them bulletproof and they could have just walked up and cuffed him as the bullets bounced off them like Robocop? Again, that's training that I think all cops need...

Police shoot to survive, not to kill. When a criminal shoots at any police officer, he becomes his own judge and jury. The Caldwell police just enforced the verdict.

My bet is that you would do whatever it takes to defend yourself. And you cant tell me that HPD ( I believe you must be talking about Houston police dept) would not do the same. I have heard of lots of instances where HPD was involved in a shooting.

I can't believe how rampant ignorance runs in our society today. I guess the uninformed will always try to be heard. To "Mom" the Police do have rules of engagement, it's called the Force Continuum. These are guidelines as to how much force may be used against a resisting subject in a given situation. The Continuum allows the Officer to escalate or de-escelate their level of force in response to the subject's actions. So to simplify this for you, this means that if you are being shot at you do not address the threat with a baton or pepper spray, you shoot him and you keep shooting until the threat is neutralized (that means he is no longer able to shoot at you, or he is dead). As for "Liz" Yes, there were two Officers addressing the suspect, but if someone were shooting at you, you would want as many guns in the fight that you could get! I know that everyone has the right to their opinion, but unless you are informed on the subject at hand, keep it to yourself. Great job Caldwell PD.

Hey Wayne...I guess you determined they shot too many times from all your combat expierience? If so great wise one, tell us exactly how you would have reacted after YOU were shot and didnt know if you were going to live through it.. If the suspect hadnt dropped his magazine he would have fired more rounds, not just one..You dont give someone trying to kill you a "time out"...unbelievable....

This suspect had robbed a grocery store any one of you or your family could have been in the store at the time. Some of the comments are astounding, my wife and I are police officers and, we fully intend on going home at the end of our shifts.The suspect had his gun up and fired before officer Hignight had stopped his car. The officer hit the suspect car and the suspect fired a second round at the officer, I think this is when he was taking cover behind his vehicle. the shootout lasted three maybe four seconds and some of you are saying it could have been handled better? I am surprised that only five shots were returned. I hope Officer Hignight makes a speedy recovery and returnes to duty soon, and, I also hope the people of the City of Caldwell realize what a special person they have working to protect them and their families. To Officer Hignight; be safe and God speed brother, I am glad your still with us.

I am disturbed that KBTX aired the shoot out without warning to sensitive viewers. I know ratings are everything but seeing the man shot and killed on TV without warning for small children to see is a step to far. SHAME on you KBTX.

I am amazed at the attitude some of you folks have about this shooting. There is clear-cut evidence that the officer did nothing wrong. The suspect on the other hand committed many crimes in the course of a short amount of time. And if you think this officer is sitting back and thinking about his next shooting, you're dead wrong! A police officer is considered a PEACE officer; they know they might be called upon to stop a threat any way possible, but any good officer knows that at the end of the day they'd rather go home with their gun holstered rather than shooting. This officer will live with the fact that he took a life. It does affect him more than you'll ever know. I am deeply proud of every law enforcement officer, paramedic, fire fighter, and military personnel that take our freedom in their hands everyday and protect it! We take our freedoms for granted way to often. It's time that we step back and give thanks where thanks are due!

I am not a violent person. I would never want to intentionally hurt anyone. BUT if someone is shooting at me or anyone in my family I am going to do whatever it takes to stop this person. Shoot to injure? Ha! I'll just bet this criminal was only shooting to injure the officers. Get real.

To all on here who say that " it could have been handled" or " A more experienced officer would have done it differently" why dont yall go to you local police department and ask to do a ride along. Usually all you have to do is sign a few papers and you get to ride. Im sure Officer Hignight would be happy to oblige as soon as his bullet wound heals. That should at least give you a little insight into what goes on. It still doesn't give you the right to critique some one else on the way they do there job. Officer Hignight was 100% right in what he did. He did his job perfectly and put his life on the line for all of us. He shoudl be comended. All of you that say different, in my opinion are not the sharpest tools in the shed.

hey john doe ...even when they give you a seat belt tickett their even still looking out for you allso cause you get in a wreck and no seat belt on you may save your life ...so the cops still doing their job saving peoples life you drive to fast...or being drunk you should be charge with a tickett ..or a DUI drunk driving you could kill some one or some one else so what i'm saying is the cops doing everything to keep people safe...i agree who ever said they get big bucks doing their job should see their pay checks they dont get enough ...they should be pay a hell va lot more then some..

well i think they shot to many times cause i feel like if they should'v shot few times and then see if man wants to give up if he shoots more then shoot again..but i do feel the cops sometimes over reacts..just like them in new york shot the guy getting married they reacted to quickly but i relise cops do have a hard job to do and they dont get enough credit for doing their job...and they knew the guy in caldwell..he was a nut case ...

Absolutely an outstanding job by the police. We are so fortunate that we don't have to worry that this parasite will victimize society again. We should embrace the excellent job that these officers did in stopping a good for nothing loser from hurting them or anyone else. I don't know how anyone can be critical of the police in this situation - don't shoot at the police and you will not be shot. It's that simple.

The reason the police dept. released that video to KBTX is b/c people are making comments about how the police officers should not have killed that man!!! Nowhere in a police officer's job description does it say he has to take a bullet from a thug that is to lazy to earn an honest living. If this piece of trash had fired at me I would have returned the favor and I am not a cop. I don't want to be a cop. Cops have to work nights, weekends and holidays in all sorts of weather. They don't get paid nearly enough and they have to listen a bunch of BS about things like this from people that do not have the courage to walk a mile in their shoes. Thank you to all of the police officers that will be out working tonight while I'm at home with my family in my nice comfortable bed. Honest people appreciate you more than you will ever know. The only people that don't like you are the thugs and ghetto rats.

The officers did what they had to do. The number 1 rule is to shoot to stop, don't shoot to injure. If you injure the bad guy there's no way to know if he's still capable of finishing you off. All you negative creeps who show more pity for the criminals of the world, just wait until you or your family is involved in a bad situation. If a gang is shooting at your family during a picnic, I do believe your tune will change and want the police to neutralize the threat in any way possible. Seeing the video today and watching the shooter shooting at Officer Hignight shows him moving the gun to the left trying to hit the officer again. This shows me that he was really trying to kill the officer. He never showed a sign of giving up. Which means to me he would have killed anyone. Im glad the officers were able to come home to their families that evening and I appreciate the bravery by the officer that ran into the car because who knows where the shooter would have ended up and who he would have killed that day. As a business owner I thank the Officers for a job well done and feel better knowing that Officer Hignight and Officer Lilly are here brave enough to protect us and I pray for them mentally to be able to know they did the right thing in protecting all of us in Caldwell.

why didnt the surveillence video from the grocery store get put on here i wanted to see that more ive lived in caldwell 12 years and i havent seen anyone rob a brookshires or walmart i wanna see how all of the people i know that worked there handled it

People Lock your guns UP. The gun that shot this officer was stolen from Bryan. You can Buy a safe for what a gun costs. It is not like we do not have a crime problem in Bryan above the state avg. We have had some homes on Bryan E.side Burglarized daytime when people are working also some people hurt trying to stop the thugs when they came home for lunch. No live and local coverage also. I personally witnessed the after effects of one of these thugs attacking a family member during a break in at lunch time. This turned in to an unspeakable bloody mess in one of the nicer neighborhoods in Bryan.

To all those who say they didn’t need to see the video, why then did you click on it and sit at your computer or television and watch it? It was your choice; no one made it for you - Just like the Robber in the video made his own choice to do what he did. No one forced him to rob a store, steal a car at gun-point from a mother and her daughter, flee from police, and then shot a uniformed police officer. Good grief, get a grip! A special thank you goes out to the men and women in uniform who on a daily basis, stand up for those that can't stand up for themselves.

Thank you "Think about it". Many of these people received their legal education courtesy of CSI, CHIPS and Adam-12. They always have a few pointers on the law for these fine professionals that protect us, but they would never dream of offering their dentist a pointer or two on performing that much needed root canal. They are the first to scream where are the police when their home is burglarized. However they accuse the police of using excessive force when a violent criminal makes a choice to place the officer in harms way and he has to defend himself. Some have suggested the officer shoot to wound. If they had ever opened up a copy of the Texas Penal Code they would see a firearm is classified as a deadly weapon. If you use a deadly weapon you had better be certain your life is in danger or you could find yourself in front of a jury. The best pistol shooters in the world are unable to shoot a weapon out of a violent criminals hand when he is moving and they are under stress.

To all the folks that have stated that it was too much for two police officers to shoot at the criminal, we will be sure and just have one cop come to your aid when you are being robbed, mugged or even raped. Just one. And we will just have them plead with the criminal to stop and only shoot to injure them. I bet your story changes then.

I don't understand why we are debating this issue. This footage never should have been seen by the public. I am not worried about the criminal who has passed, but his family and police officers families shouldn't have to see this. This is why police officers get the big bucks I guess? They put their lives at risk everyday, and get scrutinized on every decision they make. Sure they make mistakes, but this wasn't. This could have happened to a officer on his first day or an twenty year veterian of the force. They don't get to choose on this kind of thing. Welcome to Caldwell chief Lilly. I hope you know that even if we don't always agree with you, that we support you and we are thankful for all your hard work. I know if someone puts my family at risk, or I am in need of help, you aren't afraid to answer the call. I may not like it when I get a ticket for not wearing my seat belt, but deep down I know our officers are public servants with or best intersest in mind. God is love.

I am a Police Officer on east texas. We are not trained to shoot to kill, we are trained to shoot until the threat is stopped. I was involved in a shooting several years back, and my suspect did live to serve time..but I wasnt shooting to wound or kill, I was shooting so I could survive and go home to my kids. Remember, Officer Hignight was returning fire AFTER already being wounded. It was his training and will power to survive that allowed him to hit the suspect at all. Liz, since your such an expert, we have an opening. My guess is you wouldnt make it one shift

The guy knew what he was doing and he knew the consequences. He wasn't surprised at the ending, why is anyone else??? If he didn't think it was wrong, then why did he have a gun and why did he run??? HE KNEW! HE WAS READY TO ACCEPT THE CONSEQUENCES OF HIS ACTIONS!!! Isn't it amazing how many law enforcement "experts" are out there??? Those officers did an outstanding job because no one else was hurt. The suspect always had the option not to do the crimes in the first place. As for the 2 against 1, he was lucky it wasn't 50 against one because violent criminals like him need to be outnumbered.

Anytime a life is taken it is sad. However, I believe the officers did what they feel they had too. I just dont' understand how some they shoot and kill yet others they don't even when they are fired upon. Can someone explain this? Will the scale of justice ever be equal? Speaking of training for all you guys in law enforcement,even in the military there are rules of engagement. You don't get to shoot to kill or even shoot back without following these rules. Now that's what I think is crazy! It's a war!

If he was only injured he could have continued firing and killed the officer. I agree with Gerry. If you have never been in that situation you SHOULD NOT judge! He fired first and shot Officer Hignight in the arm. He could have easily shot again and killed the officer. He did what he needed to do to protect his own life. There is nothing wrong with that. Disgusted:If he shot at you, would you stop to think about where to shoot him? No, you wouldn't!

to disgusted shot to injure???are you serious? they then would sit in jail for next 60 years wasting taxpayers money!!! how would you feel if your husband,son or daughter was a police officer?? Or what if someone was shooting at you, bet it wouldnt be the same.. I pray every night that my fiance which is a police officer comes home to me and that some crazy idiot doesnt shoot him for some dumb reason and then pled insanity in court and get off..you dont clearly understand the dangers of law enforcement and im sure you never have to worry about if your husband will be comming home to you or not at the end of the day.... for everyone who has negative to say dont comment until you've walk in law enforcement shoes...They dont tell you how to do your job so why the hell critize them doing thier jobs....

I am a former law enforcement officer having served just over 7 years. During that time I discharged my weapon one time in defense of my life and in the same situation would do it again. Law enforcment officers are trained to fire aim for center body mass and fire a minimum of two times, so two officers 5 shots that's one extra shot. As far as experience, 7 months, 7 years or 70 years, any officer who is shot at is going to return fire. I would like for Kathy to post just how she thinks the situation should have been handled, that should be great reading.

How can anyone not defend the officer's actions in this case? If a person shoots at a police officer, they have decided the response of the officers for them, the use of lethal force. I'll tell you this, if someone were to shoot at me, I would not give a second thought about returning fire. Surely it is tragedy that someone died, but these officers are surely justified in there actions and are heroes for what they face everyday!

I feel like Liz is right. I feel that killing the man was wrong. They could have just shot him and injured him. Killing should have been the last option. And it was 2 to 1 I don't care how you look at it 2 to 1 odds aren't fair. I feel he should have had to serve his time for the crime he committed now he is just dead I'm sorry but where is the justice in that. Officers need not shoot to kill but just injure them so they still have to serve their time.

To Liz in Caldwell - As an ex Bryan officer I count myself lucky that I never had to shoot someone. But for the record, how many times have you and one of your co-workers been shot at? And just what did you do to protect yourself and that co-worker?? I would expect your answer to be NONE. So until you've actually walked in someone's shoes I suggest you keep your comments to yourself.

in remarks to liz's comment does it really matter how many hole are in the vehicle? seriously thede guy was shooting at both officers and their lives were in danger!!! im sure if you had a gun and someone was shooting at you you would do the same as the officers did... there job title is to protect and serve...i bet you'd feel different if say by chance you were driving down hwy 21 and the suspect was shooting at the officers and a stray bullet hit your vehicle and injured you...I just dont get some people, you want the police there when you need them but when you don't someone always have negative things to say about them. I applaud our police officers while are troops are fighting in other countries and protecting us in that aspect law enforcement officers are fighting here to protect us!!!!!!!!

first of all it was not HIS vehicle HE STOLE IT and of course they would clear them But did the grand jury REALLY look at at the car it has 5 bullet holes FIVE and TWO were shooting at ONE I know the man commited a crime and had a gun but how many POLICE officers does it take to kill him apperantly two
