Brazos County deputies say a Bryan man shot at his neighbor, hitting the 15-year-old boy in the leg.

Martin Goldsby, 40, is charged with aggravated assault. He is being held in the Brazos County jail for nearly $50,000.

Detectives say the teen was riding his bike on Magnolia Drive near Mumford Road, not far from the Lake Bryan area, when Goldsby shot at him about 17 times.

Goldsby reportedly had dropped the gun on the ground at the time. One of the bullets actually hit the teen.

Deputies also say Goldsby resisted arrest.

Texas law allows the use of deadly force to prevent the consequences of theft and criminal mischief if it occurs durring the nighttime. It is going to be interesting to see if a conviction is obtained in this case.

TO: Does it matter, You have contradicted yourself. First you stated he has copper and things that can be sold for money. Now you say there is nothing to steal. How do we know that the kid wasn't on the property to get dope if you say Mr. Golsby is such a big doper and everybody knows it. If it is known that he is in fact a doper to the surrounding neighbors better support not to let your kids out on a bike around his place. DUH who is naive?

"All of us in Bechley know this!" It might make you a bit more credible if you would spell the name of the place where you supposedly live correctly... For future reference, it's Benchley. But I do see your point if Goldsby actually is a tweaker; rabid paranoia is a symptom of meth, which would also account for the problems the cops had taking him in.

This man had no right to shoot this kid period. Despite what you all believe This man is a menace to society and drugs are ALWAYS involved with him and definitely were that night! Noone said the kids entire family are ilegal aliens! Ever thought they lived right next to each other? BINGO!!! The kid was right outside the driveway. It is a small area outside of the city limits and a lot of the kids play basketball or ride bikes right by their house when adults are outside at night. Be naive if you choose. It is sheer stupidity in this case because the perp as I keep saying has a record a mile long. Mr. Goldsby has nothing anyone would want unless you are a dope head. They all already have dibs on his place. All of us in Bechley know this!

The Eagle gives a better report of this story. I don't know how much you can actually believe Goldsby, but by his side of the story, the boy came onto his property and took something and he fired shots in the air to warn the kid and then aimed at the kid and shot him in the leg. It also says that the boy was from out of town so why would someone strange to the area be out riding a bike at 9:30pm if they weren't up to something. So maybe this guy shouldn't have shot someone fleeing but if the kid did steal from him, I can see some of his point. Neither story says if they found anything that might have been stolen from the property on the boy. Shame

And are you saying that if the bike rider has just made off with, oh let's say your $3000 laptop or even a $200 skil saw right in front of you, you should just let him go after you warn him and he flips you the bird because he knows a bike can outrun a man on foot and by the time the cops get there, he's gonna be MILES away...Not saying that this is what happened, but there's got to be some deterrent for crooks who regard cars and garages as an open invitation to grab whatever they can reach, as long as darkness keeps them anonymous.

First of all nobody should shoot a 15 year old unless their life is in danger. Secondly, this incident never would have happened if the kid's parents had supervised him properly. It is foolish to allow your kids to ride bikes at 10:30PM.

JUST because somebody has been arrested doesn't automatically make them guilty of any crime they are accused of. How do you know DOPE was involved?? Was that indicated in the news report or on the arrest report? I don't recall reading it there. JURY, Judge, Facts decide a case NOT ALL THIS SPECULATION.

The person that did the shooting had a long rap sheets. To few facts to make a Judgment on the boy. I had some property crime in Bryan also by kids around his age but I did not shoot at them. We have way to much gun fire in Bryan day and night. BPD posting on its web site to stop shooting the city up does not help.

He was arrested at 11:30 and the incident happened at 10:30 pm after dark. Sorry my teenagers don't ride their bikes after dark anywhere. Do you know how many bad things can happen? Abductions, Rapes, etc. hit by a ricochet bullet from a man trying to protect HIS junkyard, Hit by car that can't see a BIKE. We just don't know do we? All speculation at this point because there hasn't been a trial, this man hasn't been convicted. He gets a trial. Innocent until proven guilty. This is why we have a justice system. A jury decides. Parents these incidents can be cut down to a minimum if you are more careful and have more rules for teenagers.

Way to go Anonymous! You are darn right something is up when a 15 year old is out that time of night. Sounds like poor parental supervision is a contributing factor to this incident. I don't think the boy should have been shot, but he must have been up to something. If they are illegal aliens the entire family needs to be deported. ICE needs to start stepping up enforcement in North Bryan.

Oh please it is like Sanford and Son over there with a porta potty and all. Maybe the perp was arrested after some investigating Hello people. This went down way before the time of arrest. I have a two that age and sorry I don't let them ride their bikes at night that late especially in a place like that area. Something doesn't sound right about the fact this. The man was arrested at 11:30 pm. Sounds like the young man(yes 15 is a young man) might have been up to mischief. It is possible. More facts are needed before anyone rushes to judgement.

Tell us the entire story KBTX. I want to know what really happened. I don't want a bunch of speculation.

My husband heard today that the kid was an illegal alien. He should have stayed in his country of origin. If he was in fact trespassing on the shooters property and told to leave, it is difficult for me to have much sympathy for him considering there have been recent burglaries in the area. Maybe this will teach him to stay off other peoples property.

Well, to set the record straight, I live by where the incident occured and know both parties. The kid was being a regular kid riding a bike. Goldsby who fired the gun was so AMPED up on dope his eyes could have come out of their sockets he was so bug eyed. This is nothing out of the ordinary for this man. His rap sheet speaks for itself. His girlfriend is also a dope head and she constantly brings other dopers over to his house to steal him blind and get the copper, aluminum etc that can be sold at Bryan Iron and Metal. Because of this Goldsby constantly thinks someone is ripping him off! Now his beloved girlfriend won't have to make the men that come over while he is at work leave before he gets home. That worked out well didn't it? The boy is fine and walking on his leg. So all is well in Bechley and one more criminal is off the streets! Way to go BCSD! Make Bryan beautiful.

i used to have a little .25 that would fire if you dropped it. i put a hole in a friends boat like that. but it didnt hold no 17 rounds. hope the kid's ok. hope the guy gets the chair.

" However, according to a prosecutor lecturing at a domestic volence seminar, for the DA to get a murder conviction, he must PROVE intent in order to get a stiff sentence; if there's any doubt that the criminal intended to kill, the guy gets dropped to manslaughter which means he's out in a couple of years. On the aggravated assault charge, all the prosecutor has got to prove is that the guy was responsible for an injury (slam dunk in this case) and a prior bad act (criminal record, another slam dunk) to get the guy sent away for a minimum 25 year sentence with a minimum of 2/3 served before a parole hearing. Absent a self or property defense determination, the guy's gone for good.

The truth of the matter is that the teenager was trespassing, there had been several burglaries at this residence reported in the past.Warning shots were fired ( not 17 !)after the verbal warings. The young man was hit by a ricochet.There were a lot of info left out of this article. Do not jump to conclusions until you have heard the facts.

Contrary to what a previous posting says Attempted Murder is still a crime a person can be charged with according to the Texas Penal Code. Don't take my word for it. See for yourself. Google the Texas Penal code and go to Chapter 15 section 01. To paraphrase, it states that a person found guilty of a criminal attempt will be punished one level lower than they would be if the offense is complete. Aggravated assault is a crime. A deadly weapon can serve as an enhancement to an Aggravated Assault charge. A bathtub, a piece of rope or a car can be a deadly weapon by definition of the penal code. If the victim did something to provoke his attacker the more appropriate charge might be Attempted Manslaughter. I am not a lawyer. If you need legal advice go seek out a competent attorney that has passed the state bar exam.

ok, first of all, aggravated assault with a deadly weapon holds the same charge as the once called attempted murder which is no longer titled that way. its all agg assault w/deadly weapon. im glad to see all the law enforcement on this page. its amazing!!! the story is a little shy on details because its prob all the pd would give out at this time. as far as the gun dropping and then firing, is prob the suspects crazy way of defending himself, which we all know it is impossible to happen that way. so everyone chill, and wait for the rest of the story and then im sure it will all come to light. do you ppl not work, every comment sec. is soo filled up with ignorance and disbelief. i read it just to remind me of the overwhelming ignorance that has plagued our country, not b/cs only, every where. something needs to be done about that. to the boys family, regardless of what caused this incident, i hope he recovers.

The fact is this is a 15 year old boy that has been shot are you not a father or a mother? regardless of where the shooting took place and regardless of why no one has a right to shoot at someone else. >>>To answer all your questions he was riding a bike!!<<<< That hardly answers all the quiestions; In CS there have been numerous cases where someone "riding a bike" stops beside a parked car, smashes a window, grabs somethng (backpack, GPS, laptop bag, CD case, IPod, etc) off the seat or dash, tosses it in the bike basket, and boogies before even someone with a car alarm can respond...I AM assuming for the moment that your nephew's bike riding wasn't a part of that kind of stunt. Because if it WAS, it puts a whole different spin on the incident.

This is a very confusing story. So, did the gun go off 17 times when he dropped it? What was he carrying??? A fully loaded AK-47, with the trigger filed off? That is the only thing I can think that you can drop and still get off 17 rounds. If that is the case this child and Goldsby are lucky to be alive. Did anyone see this report of the news and can explain it better?

I don't know either party involved in this case but KBTX has failed to give us very many facts. Was the kid riding his bike attempting to flee the scene of a crime he committed? Was the shooter strung out on dope, like so many Bryan residents? Has either party ever been convicted of a felony offense in the past? What was the shooters motive? Had previous altercations occurred? Was the kid taunting the shooter? Was the kid dating the shooters daughter? Had the kid stolen the bike from the shooter? Was either party an illegal alien? Was the shooter an ex boyfriend of the kids mother? I want another story with a few more facts other than a man fired 17 shoots and struck a kid on a bike near the lake. Tell us more KBTX.

Yes, indeed, his rap sheet is about 3-4 pages long. Mr. Goldsby has been arrested for possession of a controlled substance, DWI, DWLI, resisting arrest, failing to get an animal vaccination, speeding, fighting, family violence, and now this. SOUNDS LIKE he is nothing but a common criminal.

This was a county incident! Along with all of the other incidents involving College Station criminals and Bryan criminals, I think it's time to move to Madison County or Burleson County. You never hear of those problems there. The whole of Brazos County (Bryan and College Station especially) have turned into a cess pit.
