Renter Asks Landlord to Clean-Up after Nightmarish Move-in Save Email Print

It's a move-in nightmare for one Bryan man, when his new digs turns out to be a dump.

"She said it was ready, and it's not ready," Kevin Ford said. "She broke the lease, her end of the bargain."

Moving day turned into one big headache after another for Kevin Ford and John Wright.

"It's not what I signed up for," Bryan Resident John Wright said. "It was dirty, not clean at all, it wasn't walked through, inspected or anything."

John says when he walked into this two bedroom apartment he found..."food in the refrigerator, inside the cabinets, and then the stove was black and gross."

"The rust that's still in there(dishwasher) there were dishes still in there, and dry food still in there," Ford said.

John and Kevin took their problems to management. Although Kevin says they agreed to send someone out to clean it up, he says management didn't think the mess was that bad.

"They said they would still move in here after all that," Ford said.

First thing Friday morning, the paint and scrub brushes are out, but the problem is far from resolved.

"All three of you said you would move in here tomorrow," Ford said to management inspecting the apartment. 'I stand by the comment,' one of the managers states back.

"I guarantee you, you wouldn't have cooked your kids a meal on this stove," Ford said.

John says this just isn't the apartment he thought he was signing up for.

"The model has new stuff, a digital stove. It's clean, that's all I was shown so that's what I thought I was getting," Wright said.

"This was the part that was really nasty," Ford says as he points to the stove. "They changed out the vent hood. It was horrible."

The old rusted stove is carried away, and a new one brought in its place.

But even after some cleaning Kevin and John still find food particles in the dishwasher, and the refrigerator still a mess.

"What do you want from us? What do you want," an apartment manager asks Wright.

"He does not want to live in a place where there's filth, literally filth," Ford said. "You guys said it was move-in ready."

"I don't want to live here, I just want to get my money back," Wright said.

At last word, the apartment manager was seeking approval from upper-management for a refund to be allowed.

Since News 3 gets dozens of complaints like this every year, we have ommited the name of the College Station Apartment Complex and it's parent company. However, since these complaints are common we have included information and resources below to help keep you out of aa renter's nighrmare like the one you read above.

The Texas Apartment Association says in instances such as these some sort of compromise either needs to be met by management and the tenant, or the tenant can ultimately take their case to be resolved by a Justice of the Peace.

Officials with the T.A.A also say the renter can and probably should request the name, and address of the corporate owner of the company to also send a written letter of their complaint to.

The T.A.A advises people looking to rent a place to make sure in the contract move-in procedures, and the cleanliness of the apartment upon move-in are clearly stated. Before signing on the dotted line, request to see the specific unit you will be renting. If for some reason it's unavailable, ask for a special provision in your contract that would allow you do a walk-through to inspect the apartment prior to moving in.

I am a property manager in this town and have been in this business for years. Several people mentioned the fact that the "big corporations" are running these properties into the ground. That is not always the case. Corporations have the captial to make aesthic improvements so the precious property values in BCS don't continue to crumble. Please remember that next time you gripe about a corporation. Now, I am ASTOUNDED at the manager's lack of professionalism and poise when dealing with these upset tenants. Things do happen and on a big property with hundreds of units to inspect, the ball can be dropped. However nasty the outcome may be the manager's responsibility is to the tenants comfort and well being first, then to the shareholders and ownership next. Had this happened at my property I would have been as upset as those guys were. Remember also that the property manager is dealing with CONTRACT laborers for the work on these units...and that is another story in itself!

It's great that all we have to talk about in BCS is a dirty stove. It could be crime we are talking about. Who cares?? Let these boys clean the stove. They probably don't get a lot of exercise otherwise. Is this what get's press around here?

I am a landlord and have many properties. If you don't like it, clean it. I am here to make money off of you. If you are too stupid to read up on the laws in Texas for tenents, then I will take advantage of you. Not really. But, there are tenent laws in Texas that you should be aware of when you are renting.

I own rental property in Bryan (duplexes) and would NEVER let a tenant move in under those circumstances!! Apartment complexes and big leasing companies are not always the easiest people to deal with. You usually end up paying a lot of money for a small place.

My daughter signed a lease in April for an apartment. When I got there (after her signing) there were quite a few things unsatisfactory. There was hair all in the bathtub, which apparently was not cleaned after the previous tenant. The dishwasher still had a plate in it and the dishwasher itself wasn't screwed into the cabinet. There were dead bugs on the carpet, which only meant to me it wasn't vacuumed. There was a leak in the ceiling from the a/c, the sliding patio door was installed backward so we can't secure it and there were smaller than standard screws used to install the front door lock. But try and get out of the lease and it will cost you....and when you move out try and get your deposit back....it won't happen. Where are the tenant's rights?

It's unfortunate but not much can be done. False advertisement is everywhere. Do you ever get a meal from a restaurant that looks exactly like the wholesome goodness you see on the tv? No. As long as the management is willing to "meet in the middle", you are basically stuck with your contract, as you can also use your rent money to make your own needful repairs. It's best to ask to see the apt before move in. KBTX would do good to make this a monthly issue to follow up on concerning all apt's in the twin cities like someone suggested earlier that is done with the restaurant ratings. It would help get the word out to those not in the know about what your rights, obligations and choices are when seeking a place to rent. I bet many do not know precisely what they are allowed when entering a rental situation. Look before you leap. It would also be good to check with nearby tenants about any maintenance issues.

Wow this is so not surprising for Aspen Square Management. I worked for Courtyard Apartments who are privately owned for over two years before Aspen Square bought us out. Of course they led us on to believe we were going to employeed by the company however, that is NOT what happened. They are complete slum lords thank God they didn't keep me on..I work for a much better management company now!

FROM NOW ON, ANYONE INTERESTED IN AN APT. SHOULD BE SHOWN THE ACTUAL UNIT, NOT A MODEL. I WOULD WANT TO SEE EXACTLY WHAT I'LL BE GETTING BEFORE I GAVE ANYONE A DIME. JUST LIKE SHOPPING FOR CLOTHES; YOU SEE WHAT YOU'RE GETTING, AND MAKE SURE IT FITS YOU RIGHT BEFORE YOU PAY FOR IT.

This is the same apartment complex that allowed contractors to use resident's electricity to remodel the complex. I know two people who lived there and thought the renovations were nice until they got their utility bill which had jumped $40-$50.

I don't know who you are that keeps trashing Bryan , but maybe you need to get out and take a closer look at your town.College Station is just as bad as Bryan , it just doesn't make the news ( dirty politics you think )If you would take a minute to read the article (if you can )it says the name of the apartment complex in the same article that says it won't name the complex . The complex is in COLLEGE STATION . Get a life and don't just get on here and blog about how bad Bryan is . If you need to comment , comment on the article don't just get on every article and trash Bryan.

RJ, why don't you learn how to read first before you post your ignorant comments. The residents are from BRYAN and the complex they tried to move into is in COLLEGE STATION. You really should not post comments because you really let everyone know that you really are not the brightest light shining. This story is not about how bad Bryan is anyway but you always reduce stories in to black v. white, or bryan v. college station. Grow up and learn how to read you idiot!

The apartments are Laurel Ridge off spring loop in college station. Look closely at the Texas sign with the LR. I used to know friends that lived there. I think everyone should know of where it is and thats where it is.

I found Mary's comment interesting that a tenant is angry after being showed a model and finding out that apartment does not come close to the model. Is that false advertising? I would assume that appliance's would be of the same make and vintage, or perhaps newer than in the model. I would however fully assume that the unit would be clean and ready when I was handed the keys. It makes me doubt the management abilities of the managers at that complex as well as their claim they would move into that apartment themselves, well I sure did not see them pulling out the sleeping bags to do so!

I object to the comment by Jason of Bryan about Finder Keepers, I happen to know the owner and most of the people working there and they by and large do a good job. They would not have been around as long as they have if they didn't. I just want to defend one of the few locally owned apartment rental agency's in town.

From the video footage, it seemed like a nice apartment, minus the dirty applicances. It seems like management did try to resolve the issue, ie: replacing the stove and vent hood. I would say to be thankful that they tried to make it right, my landlord didn't.

This is a typical scenario those of us in the apartment management business encounter when a tenant is angry about the condition of the apartment upon move in or when we show them a model and the unit they rent doesn't come close to everything new in the model. I applaud KBTX for showing the encounter between tenant and management. They also provided important information for renters and what they can do once they get into a squabble.

Response to RJ, re-read the story. This was about a College Station apartment complex. Yes, Bryan has its problems. I can also show you less-than-pristine areas of College Station. They just do a better job of hiding it. After all, College Station has a reputation to protect. It's what you don't see and hear that can be really scary.

This is not a total shock. I am wondering if these guys are renting from Finders Keepers. I would also advise them to have a camera ready to document everything. Take pics before you move any of your stuff in to show the condition of the place. Get duplicate copies and have the managment place one set with your file and keep the other set for yourself for protection. I moved into a place that had not been cleaned as well and the place that I moved out of, I cleaned, repainted, steamed the carpets ect. and the leasing company sent someone to that place to clean it and they spent an entire day there doing the same things I had already done. They didn't clean the one that needed to be cleaned and cleaned the one that was already spotless. It seems as if the smaller leasing agencies in this town are run by people who either don't care or just plain have no idea what they are doing!!!!

When you don't live in a college town the apartments will do what ever it takes to get you to move in. In a college town you can always find a renter, so they don't care what it looks like.

It honestly doesn't sound that bad to me, but I would be upset, too. Not upset enough to make news out of it, but I'd ask for a different apartment that was equivalent to what I was shown. I hope the management makes good - but there are lots of other complexes in town to rent at that would love to have them.

Bryan did not get it's reputation by being clean. I knew where this was before completing the story. Someone needs to get their act together. These people are trying to take advantage of college students. This is typical look at all the over grown lots around Bryan and the trash every where. This would be a typical Bryan apartment. The managers probably thought to their standards this was clean.

Good for John and Kevin for standing up for their rights. Most of the apt complexes are being run by big corporate offices and management at the local apt complexes state their hands are tied when making decisions as to replacing or renovating run down apts or rentals. Wish we had more people like John and Kevin who are willing to speak up for the rights of the tenants.
