An arrest has been made in connection with a fight that seriously injured a Milam County man who was trying to intervene.

Bryan resident Shannon Mushinski, 28, turned himself in to authorities shortly after 10 Thursday morning. He was charged with assault, then released after posting a $10,000 bond.

Mushinski is accused of hitting Gause resident Jerry Sowders, 48, during a July 13 fight outside a Post Oak Mall nightclub. Sowders was reportedly trying to break up the altercation between Mushinski and another person. Authorities say the blow caused Sowders head to slam into the pavement resulting in serious head injuries.

"It's a relief somebody came forward and we got it over with instead of waiting to find out who it was," said Robert Sowders, Jerry's brother. Sowders is said to be making progress in rehabilitation.

All persons are presumed innocent until proven quilty. Regardless of what you may think of Shannon, his family, or whatever you may have heard, Shannon is innocent until proven guilty. The mere fact that police issued a warrant means nothing as to his guilt. A warrant was obtained on probable cause which may include hearsay evidence (he said, she said etc.). That Shannon turned himself over to law enforcement shows good citizenship and respect for the law. It is not an admission of guilt nor should it be ignorantly construed as such. What happened to Jerry is tragic. Unless you were there and actually saw what happened you are not competent to speak about it. If you are, than give your statement to law enforcement and we will see you at trial.

I don't know anyone in the story but some of these comments are hilarious. A baby momma that doesn't care if her man is sleeping with another woman, that's classic. Please go get your tubes tied, I will pay. Jerry, stop going to a bar that almost killed you. You got lucky once and there is no need to tempt fate.

I am not sure if anyone is aware that Jerry was back in Rockies the night before his "benefit", drinking beer (a couple/few weeks later). I guess he was/is doing better than most people expected seeing he was in ICU for eight days.

Shannon is a worthless peace of trashy, who doesnt deserve to walk on this earth. Shannon treats his wife like dirt, and she doesnt deserve to be treated like that! She can call me and Ill treat her like the queen she is!!

YEAH RIGHT Kim!! If that was your brother who shannon hit, you wouldnt be saying that! I personaly know shannon VERY well, and he is trash, now his wife she's a really good person, with a big heart! Shannon is a drunk! He's always leaving his wife at home with her kids, NOT his, while he is out with his EX g/f. he, is always trying to starty trouble with his's ex, that wy he went to jail this lasttime cause he was stalking her! And why his wife puts up with what he has done to her, I dont know! I know I didnt and never will! BUT anyway I pray for His wife, and jerry's family...

No matter the character of anyone unfortunately when alcohol becomes involved, it all goes out the window. I came here to escape my small town "issues" of everyone being so judgmental. Apparently that will be anywhere I will go. You have people on here (more than likely grown by the way) that during this tragic story that take their time to just completely condemn a family by words. The funny thing is in our own ways aren't we all a little dysfunctional or excuse me "white trash"? As a wise preacher (my grandfather) use to say when you start pointing a finger you have 3 pointing right back at you. Finally as you totally try and humiliate the Mushinskis in public with your words you then in the same comment say you will pray for the other young man. Thank God our God will listen because unlike you and unfortunately me sometimes in weak moments he doesn't judge. My prayers are with the Mushinskis, Sowders, and the other party(ies) as they struggle with the right thing... Thanks

I wasn't there that night and I have no earthly idea as to what really happened. I do know that this was a terrible tragedy that never should have happened. I used to drink like a fish and hit every beer joint under the sun. A few years ago I decided to grow up and stop drinking. Since I quit drinking I have been to a bar twice. It is a pretty scary feeling when you are sober. You are surrounded by intoxicated people that are acting foolish and doing things they would not think about doing on Monday morning when they are at the office. In large quantities, alcohol can make perfectly normal, mild mannered, polite, sane people very dangerous. If you need to have a drink with your friends, it is much safer to get together at someones home. Guys fight in bars every night because a stranger accidentally bumped in to them. Most would never think about fighting someone that accidentally bumped them in HEB. If you go to bars, be careful.

IF SHANNON WAS NOT THE PERSON WHO HIT JERRY THEN HE KNOWS WHO DID.LET THE POLICE KNOW AND GET IT STRAIGHTENED OUT. HE WAS PICKED OUT OF A LINEUP BY WITNESSES.

the information that was presented to the public was incorrect. i was at the mall at the time of the fight and shannon was no where near the fight, he was behind the car watching because he didn't want to be involved, he is not that kind of person. I personally saw the man who did it and he is now out of state. The coward that did it is not even here, what kind of man is that, letting someone else take the blame. Shannon has four kids and a loving wife. just leave them alone.

To Sober: You sure are a smart one aren't you! It always becomes the bars fault when adults act like idiots that can't control themselves. This all happened after the bar was closed. The owner of "Rockies" runs a nice bar. He is there when it is open & watches what goes on inside. He will not stand for fighting in his bar. He has no control over what happens in the parking lot. How many fights have there been at "Harry's" or "Northgate" or even "The Hall of Fame"? Compared to most of the bars around here, "Rockies" is the most mature one in town. People can go there & enjoy themselves without having to walk sideways through a crowd of college students. It's simple...if you don't drink & don't want to go these establishments... then don't.

Whoever you are talking trash about Shannon and his wife, that is kinda childish dont you think? If you know anything about the situation, or have a comment towards it then post it, but to get on here and talk trash about someone just because you don't care for that person, that is childish, and noone cares to hear it!

A guy got jumped, Jerry tried to help...unfortunately got hurt in the process. There are people who were there that have gone and talked to CSPD. Hopefully this will get straightened out, and soon....Shannon is not the one that hit Jerry, and the truth will come out. I hope everyone that is on here trash talking about Shannon and his family will post a apology comment when KBTX reports that Shannon was found innocent of this.

If Shannon is isn't then why doesn't he take a polygraph, or give up who really hit Jerry? I have known he and his wife for years and they are both fighters. His wife Tammy is white trash. And I can't believe that he is already out on only $10000 bond. Jerry laid in ICU for 8 days and is still recovering and Shannon gets out on $100000 bond. What a system we have.

This does not surprise me. Shannon is trashy along with the rest of his family. I guess you could say he kinda did the right thing by coming foward but yea it's a little late you think? The right thing might have been the next day?! My prayers are with the Sowders family and Jerry for a quick recovery. All he was trying to do is keep these idiots from hurting themselves and got the raw end of the deal!

Just want to let people know that Shannon did not hit this man, yes he was there but he was not the one that did the punch. I am the mother of his child and I have had enough rumors and BS going around we all know the system sucks here and I also want to state "HE DID NOT TURN HIM SELF IN ADMITTING THIS" the detective said he had 2 witnesses saying he did it and was enough to issue a warrant and if anyone knows when a warrant is issued there is nothing you can do besides bond out and take it up in court.. so being Shannon has a wife and children and did not want to get arrested and the spur of the moment he turned himself in to clear the warrent! this will be fought in court and we has 6 witnesses saying he did not do this....I know mess will be talked because this brazos county so before people start saying he said she said think about it and dont judge till its over.....

I have known Shannon for over 13 years now and he's a good person. It's not in his character to hurt anyone. My brother was out there that night and said Shannon did not do it. It was a big guy that did it. He turned himself in to try to put an end to all this. For those of you who are so shallow minded that to think just because he got arrested that his guilty, obviously are clueless to the justice system. I'm sue the family of the victim does not want an innocent man in jail either...they just want to get to them bottom of this sad situation. I hope everyone the best and a speedy recovery for Mr. Sowders!

Gotta love what alcohol and hormones will do. I think the guy who stepped in to break up the fight was a definate good samaritan in this and I'm glad to know that the accused has turned himself in. It says to me he knows what he did was wrong and stupid and he's willing to step forward and own it.

Apparently Shannon decided to come forward & confess. If that's really the case, it shows he has a conscience and has been troubled since this tragedy occurred. He decided to be a real person and come forward and accept responsibility for his actions. To me, that means there is hope & forgiveness possible for him. He will still have to face the consequences for his actions. In regards to the victim, my prayers go out to Jerry Sowders, his family & friends. I wish Jerry a speedy & complete recovery. This is yet another senseless tragedy in our area that should never have occurred in the first place.

Shannon did not do this and I agree with Lacey they issued a warrant and he had no choice is this matter I was there the night this happened and there were lots of arguing going on but the guy drove a blue truck
