A Bryan Police officer relieved of his duties will not face criminal charges, according to the Brazos County District Attorney's Office.

Sergeant Steve French was suspended without pay August 6 for violating department regulations.

The Brazos County District Attorney's Office says it found insufficient evidence that Sergeant French used excessive force.

The department says French was suspended for use of force, conduct unbecoming, and truthfulness.

He is appealing his suspension, according to the City of Bryan. The matter is expected to go to arbitration in October.

French was investigating 23-year-old Jonathon D'Wayne Moore of Bryan, when he reportedly violated the department's regulations.

Moore has been charged with aggravated sexual assault of a child.

Court documents show Moore was having a sexual relationship with a 13-year-old girl.

According to police reports, Moore slapped the teen on June 24th, because he believed she was cheating on him.

Bryan Police have an audio recording of French's interaction with Moore. News 3 has filed several open records requests with the City of Bryan.

Each has been denied, and forwarded to the Texas Attorney General's Office.

News Three called French for a comment, but our calls were not returned.

This is in response to LeeAnn: He was kicked in the groin area! That constitutes Active Aggression at the minimum and according to the use of force scale you are allowed (not always the best method) to go 1 1 on the scale. For example, kicking someone in the testicles is an aggravated assault. That means it can cause serious bodily injury or death. Police officers are authorized to go one level higher in that case. The only level higher is Deadly force. Obviously French didn't do that because the guy is still breathing and wasn't hospitalized. If it were me, the justified response would be in the neighborhood of a knee to the chest or face. Supposedly French used foul language on the video, but wouldn't you kind of expect that if any man was kicked in that area? BPD overreacted as usual. For the record, Steve French is an honest man and not just caucasian. I believe he is Hispanic as well as Asian. He also speaks fluent spanish. Turds get more rights than cops.

Come on people wake up.Everyone on here know its true. STOP acting like race dont have anything to do with how someone is treated. Get your head out your a**es.It was even stated in the news before more blacks get tasered than whites.Then when taks results are sent out it breaks it down from different races.You know this town is really divided by your race. Its a lot of things that has happened to show the color of your skin plays a big part in how you are treated.The ones that are in denial can probably say that because you havent been in a situation where you know you were treated different because of your skin color.I dont know if he would have been treated different if he was black but people that pull the race card knows racism still exist. Either they have been treated different because of their race or know someone it has happened to. I personally have been mistreated many of times here in bcs because of my skin color.If you havent experienced it you would never know how it is.

I hate to tell Bee this, but the Good Ole Boy System is still in place in every aspect of life. It's not what you know, it's who you know. I don't know any thing about this situation other than what the news has reported...which isn't all that great. But, from the blogs it sure seems like Sgt French is well liked, respected, and probably didn't do anything wrong. It amazes me at how many "rights" everyone has, except for the people that protect us. Guess the BPD Cheif is just another "Good Ole Boy" protecting his own!

All of these comments both ways are moot. The policy violations don't have to rise to the level of criminal charges to be valid. The accused child molester has rights just like everyone else. Officers are not and cannot be allowed to administer street justice, unless you want them to be allowed to do so for any crime. In addition, I am more concerned with the alledged truthfulness violation. The only real difference between the cop and the criminal on the witness stand is that you should be able to believe the cop is telling the truth. On the other hand. I doubt many of you if any know the details on either side. Let the system work. Then gripe all you want.

With the way Bryan treats it resident thugs you would swear they were on the endangered species list and needed protection so they could multiply. This guy needs to get his job back and then we need to clone him. It's about time someone stood up to these Bryan ghetto warriors. Maybe we should let him drive the new APC Tank that BPD is buying so he can crash a few ghetto housing areas and parks.

where i live people well lets call it the getto police are often called so i have seen sgt french in action white, black,and hispanic you name it he deals with it unlike you people hiding behind your little keyboards. this man puts his life on the line everyday so that you people can sit safely behide your hps and make dumb comments i have never seen him use exforce on anyone and belive me some of these people you just want to choke. so sgt french i know that the head lines well soon read We Are So Sorry SGT. French can continue keeping our city safe from "CHILD MOLESTER" and other crime...To bad our city official and the ones in control of the safety of our streets can't see the importance of integerity and the bravery of SGT. I agree, what have we come to when we place more emphasis on the arresting officer, and less on the...ahem....child molester. Because I'm sorry, you can't have a serious relationship with a 13 year old. There is no relationship there. You are molesting them physically and taking advantage of them mentally. Anon's statement about a "responsible young man" is putting it mildly. There is a special spot for that "young man" where he is going....it's dark and it's hot.

Bee, the good ole boy days are long and gone but it never fails that when a person of color can use the color of thier skin to thier advantage it never fails. so is there a double standard here. Further more your identification of the suspect as "young man is Black" statement shows where you stand because a responsible young man does not have a relationship with a 13 year old girl

First of all you want to blame the police Chief for the problem with French. There is so much prejudice here in this city, you can see this from all of your statements or comments. Most of the officers that left when the chief was hired left because they didn't want a man of color giving orders. God sees no color. I am not saying the young man was right in what he did, he should pay for the crime he committed as well. There are rules and regulations in all work places and they must be followed. You are trying to make it seem as French was put on leave because the Chief is Black and the young man is Black. I don't think the Chief would have made any differece if the young man had been any other color. The good ole boy days are gone. Everyone must do their part, accept it or get out like the others did. Turner is up for re-election, he's not going to rock the boat. Let the PD and Chief do their job, they may have to come to your rescue.

Firing a good cop is normal in Bryan. This is one of the reasons crime is out of control in Bryan and is now in CS. The slums and ghettos of Bryan are the fastest thing growing in Bryan for the last 25 years for a reason. We love all the thugs and run off the good police Officers.

What people fail to understand is that are two standards of law that apply in this case. One is criminal law and the other is employment law, under the civil service standards. Each of these law points has their own standards of proof. Under criminal law, you must have prove beyond a reasonable doubt. Under employment law, you need only have prove by the preponderance of the evidence. Even though the DA decided there was not enough evidence to charge him criminally, it doesn’t resolve or excuse Sgt French from the allegations he violated Department Policies. It will be interesting to see what the video tape shows. Lets pass judgment on BPD and Sgt French then.

I hope BPD is paying attention to this. This man should not have had to endure this public humiliation. Who ever brought this accusation up; well I hope he or she has to endure the same. Someone needs to be held accountable.

Bryan has alot of good Officers but they cannot do their jobs because of people like this. Also the Department will not stand behind their Officer. Do you want this in your Police Department?

There are still two more departmental charges pending. Hope they are untrue. However; if untruthfulness is proven, Sgt. French is no longer needed on the force.

Susan, Police Chiefs are appointed not voted on here. I am sure the process was vetted and followed all the political correct guidelines. Anyway Round 1 to Sgt. French. It's beginning to sound as if Sgt. French was rude to this child molester and failed to show him the proper respect and therefore didn't follow BPD procedures.

Can anyone say cart before the horse. The fact there was no excessive force means that the appropriate force was used under the circumstance. Problem is that the policies at BPD are so arbitrary, they can make anything look like a violation. I wonder if this were a hispanic suspect or White suspect, whether or not French would lose his job......Probably not. Nice job BPD

i don't know anyone involved and can only say hey the the offender was a child molester!! what's wrong with this city, the boyfriend should be under the jail with NO rights. let the offier back to work with a big raise.where are the girls parents also? why are they letting her date an older man? especially an abusive one

BPD has a history of firing good officers after problems with HUD rats like this. If we had more officers like this in Bryan it would be a safer place. GIVE THIS MAN HIS JOB BACK.

No criminal charges filed by the DA's office? Sounds like Sgt French did nothing wrong. Keep your head up Sgt French everything will turn out fine and you'll be back at work before you know it.
