The Texas Court of Criminal Appeals Monday stopped this week's scheduled execution of a Houston gang member.
Derrick Sean O'Brien had faced lethal injection Tuesday over
the 1993 torture-slayings of two girls in Houston.
O'Brien was one of six members of a gang convicted of killing
14-year-old Jennifer Ertman and 16-year-old Elizabeth Pena.
Five defendants received the death penalty, although two
sentences were commuted to life in prison and another is being
O'Brien would have been the first to be executed for June 24th,
Lawyers for O'Brien, who was 18 at the time of the slayings,
asked the U-S Supreme Court to stop the execution so justices could
review the case.
They also asked the Texas Court of Criminal Appeals to step in,
contending the lethal injection process is unconstitutionally
