Family Sues After Texas Boy Crushed By Tombstone
The family of a Texas toddler who was crushed by a tombstone is suing the cemetery where boy lost his life.

The family of a 2-year-old boy who died after he was crushed last week by a tombstone has filed a lawsuit against a Pearland cemetery.
Giovanni Rodriguez died Dec. 13.
Police said he and a group of children may have been playing on headstones at the cemetery.
His parents, Francisco Rodriguez Cardenas and Maria De Los Angeles Yanez Laura, filed a lawsuit Tuesday against the Southpark Funeral Home-Cemetery-Crematory that alleges the funeral home operator was negligent for not ensuring the headstones were more stable.
Cardenas and Laura were at a funeral service at the cemetery when the incident happened.
Giovanni died of his injuries later that day.
Attorney John Shipp, who represents the funeral home and cemetery, declined to comment on the lawsuit.
He said his clients were saddened by the accident and offer their condolences.

look people you have it all wrong the boy was just sitting behind the headstone,and some older people were leaning on it. Then eventually it fell on him.He wasn't playing on it or nothing he was just sitting down. I was there on a funeral of a family member, once the people from the cemetery finished buriyng him they said you can all live now, but yall know people still want to stay with the family member another little moment. But suddenly about 5 minutes later it failed. All the people screamed the boy! the boy!;once they tooked the headstone of him laura screamed my boy!my boy! then they called the ambulance and it came but it was 2 late i herd everything and saw everything except when it fell on him!! and it wasnt hes parents fault,or the people from the cemetery it was nobodys fault cause it was a big accident! i wouldnt sew the people from the cemetery because it would just wouldn't feel right to spend that money;its like saying because of my sons death im rich now!
The parents are responsible for their children. Period. Not the cemetery where the parents were letting a 2 year old play. Accept the fact that you should have been watching your child and move on.
I can tell you what will happen here. These parents are like so many I have seen, the kids run the parents, so much so that they let him play around in a cemetary without the respect that most of us were taught as children. Always respect a grave sight! This baby should have been walked around the cemetary and shown how to walk around also. They will probably win claiming the sign was not in Spanish or there was no one there that spoke Spanish to explain directly to them that the tombstone just might settle. After all the land does settle and we don't know how old this stone was. It may be that it was fairly new and not completely set yet. This is not romper room for God's sake but a final resting place! Have some respect for the deceased and keep your toddlers off!! They will just win the lawsuit and mail the money to Mexico anyway! The parents are negligent any way you slice or dice it but at the same time may this sweet baby rest now in the arms of Jesus.
