The charges are still aggravated assault for Bobbie Ray Tates, at least for now.
Tates is accused of shooting his wife back on August 25. Carolyn Tates died as a result of those injuries on Wednesday.
It will be the Brazos County District Attorney's Office that will make the decision on upgrading Tates' charge to murder. That will be based on a review of the Bryan Police Department's report.
If those charges are upgraded, the 53-year-old will be served the warrant in jail, where he remains on a $150,000 bond.
