Former TCEQ Regulator Testifies in "Toxic" Chemicals Lawsuit

New details in a Burleson County trial, alleging an area tie-plant caused a Somerville man's cancer.

In the second full week of testimony, attorneys for the plaintiff questioned Leigh Ing, a former TCEQ regulator, about the reporting standards for the Burlington Northern Sante Fe Railway Comapany.

Ing told a panel of jurors that BNSF was responsible for self-reporting its emissions and chemical handling process, and therefore was never cited for any pollution violations.

She also testified that BNSF should have and would have been cited for air quality violations based on evidence that has been presented in the trial, but never reported.

It could still be a few more weeks, until the defense will present it's panel of experts.

Dennis Davis, a long time employee of the tie plant claims the Somerville tie plant did not protect him or others from toxic chemicals, causing them to develop cancer.

The trial is expected to last three to four weeks.
