A new trial has been ordered for a College Station man convicted of murder. The 10th Court of Appeals in Waco has overturned the verdict after ruling that the defendant's confession was improperly allowed into evidence.
The decision negates the conviction and 10 year sentence imposed on Roger Guy Russell Junior, 26, in May of 2004. A Brazos County jury found Russell guilty of the stabbing death of James Davidson following a fight outside a College Station night club in 2003.
The Appeals Court ruled Russell's confession should have been disallowed during the trial because it was made after he requested an attorney.
No date has been set for the retrial.
