A Rusk County grand jury will consider charges against the owners of two pit bulls that attacked and killed a 10-year-old Texas boy.

Gregg County Justice of the Peace B.H. Jameson pronounced Justin Clinton dead at a Longview hospital after the attack on Monday in the small community of Leverett's Chapel.

Rusk County Animal Control Officer Allen Langley said the dogs were euthanized shortly after the attack and the bodies were sent Tuesday to the Texas Department of Health in Austin for further testing.

The two dogs attacked the boy as he rode his skateboard.

Some witnesses said they saw the dogs dragging the boy along a roadside.

A passerby used the skateboard as weapon and managed to pull the dogs off the youngster.

Sheriff Danny Pirtle said if the owners are indicted, they could face charges under Lillian’s Law, which makes unprovoked dog attacks on a person who dies a second-degree felony.

The stiffer penalties are the result of a measure the Texas Legislature passed in 2007 called “Lillian’s Law” in honor of a 76-year-old Central Texas woman who was killed in 2005 by six dogs that got out of a neighbor’s backyard.

it disgusts me to read people saying that all pit bulls need to be killed. Just because this severe case happened, doesn't mean we need to generalize and say "all pit bulls deserve to be killed". Yes, pit bulls tend to be slighly more aggressive, but all dogs can be when provovoked. If you decide to own a pit bull you have to be willing to take care of them and provide proper training. I feel for the family and my condolences go out for your loss. The owners need to pay, not the animals. They can't help the kind of care they get, and when they aren't trained, things like this happen.

I'm glad to hear about this "Lillian's Law" it sounds just and fair to me. However, I don't blame the breed of dog for this attack. Pit bulls are very powerful canines and unfortunatly are highly favored by low lifes and people that don't have enough sense to care for an ant farm.

These dogs are way too unpredictable. They should be outlawed. If you own a pitt bull,or any dog, you are responsible for keeping them under control. If they hurt or kill someone, it is your responsibility.
