Joan Scroggins, a Burleson County assistant district attorney, has been dismissed from death row inmate Anthony Graves' second trial.
Scroggins served on the prosecution team that helped send Graves to death row in 1994.
According to District Judge Reva Towslee Corbett's ruling, Scroggins will play no part in the retrial.
Graves was convicted of capital murder in the 1992 deaths of a grandmother and five children in Somerville.
A federal appeals court in March threw out Graves' 1994 capital murder conviction when it found prosecutors withheld two statements that could have swayed jurors during his trial.
