He's accused of killing a Burleson County father and son. Now Myron Phillips will face death for the crimes.
Phillips had until Monday to decide whether to plead guilty or stand trial.
District Attorney Bill Parham says Phillips wants to be tried for the crime and the state will seek the maximum punishment.
Phillips was given the option because of concern for the children who'd be called to testify in the capital murder trial. If he would have pleaded guilty, the state would have considered offering Phillips life in prison without parole.
In April of last year Phillips allegedly gunned down David Weichert and his son D.J. outside of their Burleson County home. The murders prompted an eight hour manhunt, followed by a stand-off.
