Man Killed in Struggle with Houston Officer

A man involved in a struggle with a Houston police officer was shot and killed today after using the officer's stun gun to attack him.

Officer Leonard Smith was taken to a Houston hospital after he was struck in the neck and right shoulder by the Taser stun gun.

The man was identified by relatives as 23-year-old Robert McIntosh. He was a passenger in a car that the officer had stopped because of a defective tail light.

Police say that after the officer had taken the female driver into custody, he returned to the vehicle and asked the passenger to get out of the car. The officer had smelled the odor of narcotics.

Police say the passenger began fighting with the officer as he tried to place him in the patrol car. The officer attempted to stun the man with his Taser after a fight ensued.

Captain Dwayne Ready says the suspect was able to grab the officer's hand with the stun gun and turned it on (him).

Authorities say the officer moved away and drew his weapon, shooting the man in the chest.

However, one witness says the suspect was handcuffed when he was shot. She also says the officer beat the suspect on the face with a flash light after firing the stun gun.

The shooting was the second officer-involved one in Houston in as many days.
