HUNTSVILLE, Texas -- Death row inmate Johnathan Moore faces execution Wednesday in Huntsville over the 1995 slaying of a San Antonio policeman.
The victim was 29-year-old Officer Fabian Dominguez. Authorities say Moore was one with two other men in a car in a driveway in the officer's neighborhood when Dominguez confronted them.
Investigators say Dominguez was on his way home after his overnight shift and he interrupted a burglary. Officials say Moore used his own handgun to shoot Dominguez, then used the policeman's revolver to shoot the officer in the head.
Moore was arrested the following day after a vehicle chase into Bandera County. The two others with him the night of the shooting were arrested later and are serving prison time.
The US Supreme Court in November refused to review Moore's case.
The execution would be the second this year in Texas.
