Three Texas Alcoholic Beverage Commission agents involved in the shooting death of a man who allegedly tried to run them down won’t face prosecution.

The Travis County grand jury declined to indict the trio Tuesday in the Aug. 16 shooting of Steven Lunt, 25, of Austin, who died on Sept. 2.

Travis County District Attorney Rosemary Lehmberg said one agent fired 16 times.

Lunt was hit three times.

TABC officials said agents shot Lunt, at an apartment complex parking lot, after he allegedly tried to run them down in his car.

Lunt had a blood alcohol level of 0.18, which is more than twice the legal limit for driving.

The TABC agents still face an internal affairs review.

Commission officials said policy changes have been made since the shooting, including teaching more de-escalation techniques.
