A man recently sentenced to life in prison has been charged with capital murder in the death of a 64-year-old Waco woman.

Gloria Campos Viera died from smoke inhalation after being beaten by a burglar who set fire to her home a year ago.

Waco police filed the charge against 35-year-old Tony Wayne Swinnie on Monday. The one-year anniversary of Viera's death was yesterday.

Eight weeks ago, the five-time convicted felon was sentenced to life in prison for assaulting a 62-year-old woman in front of her two grandchildren at a local liquor store last August.

If Swinnie is indicted on the capital murder charge, he would be eligible for the death penalty or a second life sentence.
