A Bryan man who committed murder the day Hurricane Ike made landfall has been denied a re-trial.
O.C. Hayward is serving a 99 year sentence for killing Wesley Miller.
On Monday, a judge denied the motion for a retrial citing insufficient evidence.
The request will now head to the 10th Court of Appeals.
Hayward's accomplice in the crime, Bennie Smith is serving a 60 year prison sentence. Hayward's sentence was more severe because he was the one who actually stabbed Miller.
