An internal review finds that two Texas Alcoholic Beverage Commission agents who shot and killed an Austin man who was trying to run them down with his pickup were justified in using deadly force.

The Austin American-Statesman reported Wednesday that the review found the agents were acting within their authority in the Aug. 16 shooting.

Attorneys for agents Joe Cronin and John Altum say both returned to regular duty this week.

They shot and killed Steven Edward Lunt, 25, when investigators say he tried to run over the two agents with his pickup.

Lunt later died of his injuries.

Officials said Lunt's blood alcohol level was above the legal limit for driving.

A grand jury declined in November to indict the agents.

The TABC report, obtained by the newspaper, did not address potential policy violations by the agents.
