Prosecution to Proceed in Pastorini DWI Case

Blood alcohol results are in for a former NFL quarterback arrested in Bryan for DWI.

While the Brazos County attorney's office will not disclose what the levels were when Dan Pastorini gave a blood sample, an assistant county attorney says they were high enough to proceed with prosecution.

The former Houston Oilers player was arrested in April after a late night traffic accident. Pastorini refused a breathalyzer, so a subpoena was issued for a forced blood draw.

At the time, Pastorini was in town for a charity golf tournament.

"The 5th Amendment comes to mind." How does the 5th come into it? That one says that you can't be compelled to SAY (verbally or in writing) whether or not you did something... This is a SEARCH AND SEIZURE of physical evidence upon your person or property, which is covered by the 4th; The warrant is required to insure that that there is sufficient probable cause to keep that seizure from being considered "unreasonable".

Fifth Amendment? When you apply for your Texas drivers license, you consent to sobriety tests. It is called ... implied consent.
