A Bryan daycare shut down by the state is appealing the decision.
Camelot Learning Center was closed earlier this month when the Department of Family and Protective Services determined it failed to meet minimum standards.
The agency had been closely monitoring the facility since September when 5-month-old Lincoln Shumbera was reportedly dropped by a caregiver.
He suffered head injuries and underwent brain surgery.
Within the next month a hearing will be held in Austin.
Camelot Learning Center will be given the chance to state their case to child care licensing staff as to why their license should be reinstated.
If the revocation is upheld, Camelot has the right to request a hearing with an administrative law judge.
