BRYAN- A Brazos County jury Thursday convicted Filemon Herrera, 66, of Bryan of Continuous Sexual Abuse of a Child Under the Age of 14.
Herrera was then sentenced to 45 years in prison without the
possibility of parole.
Prosecutors were able to prove that between 2011 and 2012, Herrera committed multiple acts of sexual abuse against a seven-year-old child with whom he was acquainted.
Prosecutors called on numerous witnesses during the trial, including the victim.
In addition to the victim, prosecutors called on an adult woman who testified that when she was a child, the defendant also sexually molested her. No charges were ever filed in that case because the victim did not report the abuse until she was an adult.
After an initial CPS report, the case was investigated by the Bryan Police Department.
Continuous Sexual Abuse of a Child is a relatively new criminal offense. It requires that prosecutors prove two or more incidents of sexual abuse during a period of 30 days or more in duration.
A defendant convicted of Continuous Sexual Abuse of a Child Under the Age of 14, faces a mandatory punishment range of 25 years to life in prison.
A person convicted of this offense is not eligible for parole and must serve their entire sentence.
The law took effect September 1, 2011.
