An appeal from a Bryan man who's on death row for killing his ex-girlfriend is now denied.

Attorneys for Carl Henry Blue, 46, wanted to declare to the Court of Appeals that he's mentally impaired, which would make him legally ineligible for execution.

Blue was convicted for the 1994 killing of Carmen Richards-Sanders,38, who was set on fire at her apartment in College Station.

A three-judge panel rejected Blue's arguments Thursday.

Blue doesn't have an execution date, and could appeal his case to the U.S. Supreme Court.
