The Dallas County district attorney wants a district judge to throw out a contempt citation connected to his refusal to answer questions about why his office prosecuted an oil fortune heir.

Craig Watkins' office filed a motion Wednesday before State District Judge Bob Brotherton of Wichita Falls to dismiss the order against him.

Another judge, Lena Levario of Dallas, held Watkins in contempt March 7 because he would not answer questions in connections with allegations that his office prosecuted oil heir Al Hill III for mortgage fraud as a favor to a friend and donor.

Brotherton said Wednesday that he expects to hold a hearing on the issue in mid-April.

Watkins' office also filed a notice Wednesday that it intends to appeal Levario's dismissal of the cases against Hill.
