BURLESON COUNTY, Texas A lawsuit against a retired Burleson County District Judge accusing him of negligence has been dismissed for lacking merit.
The anti-abortion group The Texas Center for the Defense of Life filed suit in October after Judge Terry Flenniken allowed a 15-year-old girl to return home with her grandmother, Jean Slovacek, and her boyfriend Edward Clinton Lee, a convicted sex offender.
Six months later Lee murdered Slovacek and also sexually assaulted the 15-year-old girl before she managed to escape.
The Texas Center for Defense of Life also says Lee wanted her to have an abortion after she became pregnant with her teenage boyfriend.
Lee was sentenced in April to life in prison without parole.
"She herself both in chambers in front of himself and his court reporter and also in open court later on in the hearings, this is back in February 2012, said she did not feel any risk. She did not feel she was ever forced to do something she didn't want to do. She didn't have any fear about her security," said Mike McKetta, Attorney for Judge Terry Flenniken.
Flenniken retired at the beginning of the year after serving for 12 years.
