COLLEGE STATION - A Texas Alcoholic Beverage Commission investigation is looking into what police said was a case of an unruly Texas A&M student who assaulted an officer at a Northgate nightclub - all while the underage man was intoxicated.
According to police, officers arrived at Social Lounge in the 100 block of College Main after several people were reportedly fighting.
Police said they found Samuel Sheppard, 20 of College Station being restrained by several people. While police attempted to detain Sheppard, they asked him why he had been drinking since he was under the age of 21.
According to the police report, Sheppard did not deny being under the influence. He laughed and said to officers, "you know how it is."
While Sheppard resisted arrest, police said Sheppard became violent and kicked one officer in the groin area.
News 3 spoke with the TABC to get a grasp just how common under serving was and if they believed it happened at Social Lounge this morning.
"We'll conduct an administrative investigation to determine if the bar had anything to do with the violation," said Randy Field, TABC Regional Director.
According to Field, Social Lounge was issued their permit in July of 2012. Since then, the TABC has received three complaints of minors possessing alcohol, but investigators said they had no proof to back those claims. Social was only docked a $600 fine for their failure to report a complaint to the TABC last April.
News 3 contacted Social Lounge for a comment. Although they declined to go one camera or release their affiliation with the nightclub, the employee denied any possibility of a minor being served at Social. They said Sheppard likely drank at home prior to the fight at the nightclub.
Lt. Chuck Fleeger said they are working with the TABC and take underage drinking very seriously.
"If we're made aware of a problem inside of an establishment with minors either consuming or attempting to consume, we have officers that are assigned to that area on our busy weekend nights and that is something they certainly investigate as well," said Lt. Fleeger.
Sheppard is being charged with assault on a public servant, resisting arrest and public intoxication.
