Bryan Man Arrested for Driving Drunk with Infant

A Bryan man is behind bars accused of driving drunk with his five month old daughter in the back seat.

Marcial Zarate, 32, is charged with driving while intoxicated and is being held on $8,000 bond, along with an immigration hold.

Police say Zarate rear-ended another vehicle and fled. The driver of the car was not injured, but called police after noticing a baby in the backseat.

Zarate was eventually arrested after allegedly admitting he had several beers before getting behind the wheel, failing several field sobriety tests, and police say his blood alcohol level was more than twice the legal limit.

The infant along with her mother, who was a passenger in the car, were not hurt.

According to police reports, the infant's child seat was not properly installed in the vehicle. It was reportedly just sitting on top of the rear seat and was not secured with seat belts.

I am not usually one to judge without all the facts of a situation, but it irritates the crap out of me to hear about some ignorant parent driving drunk with an infant. I think those people should be charged with something greater than just driving while intoxicated. They are putting an innocent infant who has no ability to make their own decision to get into a car at risk. The mother was in the car...what is her excuse for not standing up and saying no to placing that child in the car? And not even properly strapping the child in? I feel strongly about protecting children from ignorant parents/adults. I know that mistakes are made, no one is perfect, but willingly getting into a car WITH AN INFANT after you have been drinking is not a mistake. That act is done willingly and on purpose, and there is absolutely no excuse for that kind of behavior.

THE PENALTY FOR PUTTING A CHILD IN THAT KIND OF DANGER NEEDS TO PACK A STIFF SENTENCE. SOMETHING THAT WILL GET THE PUBLICS ATTENTION. SOMETHING SO STIFF THAT EVEN THE DRUNK WILL THINK ABOUT. THINK OF THE CHILDREN WE HAVE LOST.
