Controversial professor Ward Churchill won't be teaching at the University of Colorado next semester and probably never again.
Chief Denver District Court Judge Larry Naves denied Churchill's motion for reinstatement at the university and for any pay. The judge also granted the school and the CU Board of Regents immunity from being sued.
CU Chancellor Phil DiStefano said the judge's ruling is a victory for the university and that it allows the school to set and enforce its own academic standards. DiStefano said that most of the faculty supported Churchill's firing and would not want him reinstated.
CU fired Churchill in 2007 following a two year investigation into allegations he fabricated some of his academic publications and research.
Churchill claimed he was fired over a controversial essay he wrote that compared September 11th victims to a Nazi. A Denver jury last April ruled
that the school did fire him after the controversy erupted over the essay. But it only awarded him one dollar in damages.
But the judge said the university does have the right to set its own standards of academic integrity. A committee that investigated Churchill did find he committed academic fraud and recommended he be fired.
Churchill has 45 days to appeal and the university expects the battle isn't over yet.

Alex, at the time King's plagiarism came to light he had been dead for over twenty years. Just what action did you expect from academia? Had this same thing happened to a living individual, his lawyer would invoke the Statute of Limitations and the court verdict would be a true precedent setter. Chances are a jury would not convict the individual, and would be furious at the university for wasting their time.

We have to forgive Alex. He is doing his best to defend the indefensible. Churchill's comments had nothing to do with his firing, except for the fact they caused serious scrutiny to be brought onto all of his work which exposed his plagiarism. This is why he was fired, not because of his comments. Now Alex, how about telling us if you agree with Churchill's comments?
