College Station Man Jailed After Dog Annoys Him Save Email Print

A College Station man is charged with deadly conduct after allegedly shooting his shotgun near a neighbor's home.

Police say Gary Bingham, 40, was angry with his neighbor's dog because it barked incessantly.

Residents in the 1300 block of Airline Drive called 9-1-1 about 8:45 p.m., complaining that a man was standing in a nearby yard pointing a shotgun at a dog.

Officers converged on the area and made contact with the suspect.

Due to the reckless nature of his actions and having fired the weapon in the direction of a habitation, the suspect was taken into custody for Deadly Conduct.

If Bingham is found guilty of the Third Degree Felony, he could spend up to 10 years in prison.

Maybe the guy reported the nuisance and got no assistance from the City of CS. Renters (graduating TAMU Masters students needing quite time to study) in my duplex complained to CS about a constantly barking dog tied in an unfenced back yard on Airline. The investigating animal control officer said the dog's owners were violating no laws, so there was nothing they could do. With a constantly barking dog, I'll probably have a hard time renting the place when these guys move out next month.

Gary just needs to move to Bryan. You can "accidently" shoot a dog and not be charged with anything!!!!!!! You got to love Bryan PD

My comment is about all the people complaining about the noise. So is it ok to have one of those loud cowboy, redneck trucks that when they start their truck it sounds like a bomb just went off? I have a bunch of redneck neighbors that have those loud annoying trucks, am I allowed to go shoot at them???? That would be cool too. I always bring my dogs in when they start to bark because it is annoying but what about every other noise that bothers me. I hate to hear the birds in the morning should I go and cap them too? And crying babies.... should I cap them too???????

Gary should have just shot the dog! My neighbors are so rude. Their dogs bark constantly. It's sounds like they're killing a cat. That is so inconsiderate! Shoot it next time, Gary!!!

My right to swing my fist stops where your nose begins. This problem could have been avoided if the dog owner had just one ounce of consideration for his neighbors. That's whats wrong with the world today. The heck with everyone else! Me and my personal convenience are all that matters. Dog owners that allow their dogs to disturb neighbors should be jailed right next to the guy that fired the gun. Most neighborhoods have at least one inconsiderate jerk that allows his dog to run free or bark nonstop. If your dog barks you should bring it in the house, move out in the country or get rid of it.

The police do not have to give two warnings before they give a ticket. Plus, like someone else mentioned, not all of the facts are known. Did he ever call and complain about the dogs? What was in his shotgun? A lot of assumptions are being made without all of the information. Armchair quarterbacking at it's best.

Firing any gun anytime in the city can be dangerous. Lets hope the Police used some good judgement on the felony charge and it did not need to be a ticket. CSPD used some bad Judgement in the past on charges with firearms.

>>>>I have no problem with what the police did, but I do with the above person but not at the felony 3 charge level.<<<< As I said earlier, I think it depends on a lot of circumstances that weren't included in the article; the police in Bryan were probably careful (hopefully, one in Oklahoma accidentally killed a kid shooting at a snake last year) to insure that they had a safe background; the guy in College Station may not have.

We had a shooting of a shotgun 2x in Copperfield at a injured deer this weekend by the Police. I bet you the Police buckshot was just as dangerous when fired near Fm 158 by a gas station and homes. Felony charges are to severe for the type of crime. I have no problem with what the police did, but I do with the above person but not at the felony 3 charge level. The difference of living in Bryan. Some of us know what real crime is and who is dumb person.

The story is too incomplete to tell what the charge should have been; if he just fired birdshot into the air, it should be discharging a firearm in City limits, if he dusted the dog with it, it should be animal cruelty, and if he fired at the house or used anything heavier than 6, the charge is correct. In his defense, I suspect that he tried to do it right, but the neighbor played the "he's not barking NOW" card when the cops showed up; we played that game with one of our neighbors...The police can't do anything if they don't hear the dog barking, and have to give warnings the first two times that they do. HOWEVER, a nozzle on a water hose worked MUCH better than a gunshot ever could have for us; half a dozen squirts and yappydog shut up and split for his doghouse as soon as the porchlight came on, and after half a dozen times turning on the light when he barked, he gave up completely...

I don't know why there is such a passive approach to noise. Any noise that is unnecessary should be subject to fines. Loud radios are unjustifiable. If there is an ordinance about loud exhaust, there should be one for radios that is ENFORCED. Someone may not have the money to fix their car, but others waste money on audio system specifically designed to be too loud. Between the two, the police should be focussing on the latter. Anyone who honks their stupid car when locking their door ought to be fined at the very least - it is just noise pollution.

My husband just built us a beautiful arbor in our backyard so that we may enjoy our summer evenings together. This weekend, we had to retreat to the inside due to approximately 6 of these animals barking in our neighborhood. I completely agree with jerry in college station--code enforcement is not being done. We pay taxes AND neighborhood association dues, but what do we see in return?

This is such bull!~ I am in total agreement that the neighbor should also be charged in this matter..If a dogowner is ticketed more than four times for their barking mutt than they should be forced to get rid of it..I hope the judge dismisses this case altogether..I do agree that the guy shouldn't have fired the gun but also I can totally relate to his frusteration...Thankfully, I too live in the country!

Come on, he wouldn't be complaining if the dog was barking at a potential burglar. He should have used a hose instead. Dogs really understand that.

What has happened to respecting and being considerate of a neighbor's peace and quiet ? I do not condone what action the neighbor did with the gun ! I thought that the city had an ordinance about loud barking dogs! Another example of code enforcement not being done?

While it is a dogs nature to bark, also consider the circumstances. There could be factors that make the dog bark, or even a false charge about the dog constantly barking. Either way, you pull a gun, especially on something petty as this, expect whats coming for you. In Texas, pets are considered property, and criminal mischief at night can be justified with equal deadly force, so he should be grateful nobody at the house was armed.

I understand the annoyance but not his method. Still, 10 years in prison seems a little harsh. Of course, i wouldn't want a neighbor, if I had one, pointing a gun at my house regardless...

sounds like a bogas charge. You shoot a gun in any direction, it'll be in the direction of a habitat. people need to be responsible for their animals, and considerate of their nieghbors.

I can't blame this guy for being upset with the dog, though his method of wanting to quiet the dog is too extreme. People need to learn to respect their neighbors. Unattended dogs barking repeatedly and loud music playing like they're the only ones around annoys me! Heck, you can't even go to the car wash without people playing their "bumping" music too freaking loud! If his neighbor had any respect, it wouldn't have come to this. This is why I live in the country!

He didn't go about it in the right way, but I understand having neighbors that will not quiet their dog. Perhaps the neighbor could share any jail time for disturbing the peace.

I hope he does get some kind of punishment or a fine at least.I hope he doesn't have kids!!!!He might do the same thing if they were crying.It is a dogs' nature to bark.
