Two years after a drive-by shooting happened in Bryan, police say they have arrested the man who fired the gun.

20-year-old Jose Martine Diaz, Junior allegedly shot at several cars on Elsie Lane in November 2006. Two people were inside one of the cars at the time, but no one was injured.

Diaz was arrested the same day for theft, when police say they found several stolen guns in his possession. Diaz's hands were also checked for gunshot residue and the evidence collected was sent to the Department of Public Safety Lab in Austin for testing.

Two months ago those results came back positive for gun residue.

Diaz is currently in the Brazos County jail facing two charges of engaging in organized criminal activity. He was out on bond for a slew of charges at the time of his arrest.

Burglary, firearm possesion by felon, theft, evading arrest, the list goes on for the past few years. Why is this criminal not in prison? We need the 3 strikes law.
