Sexual Assault Charge Sparked Katy Man's Rage

News Three has obtained new information about the events leading up to a shooting spree in Burleson County.

According to court documents, Myron Phillips, 35, murdered his stepchildren's grandfather and father, David Weichert Sr., 62, and David (D.J.) Weichert Jr., 35, outside their home early Wednesday morning.

Officials tell us Phillips was accused of assaulting his 12-year-old stepdaughter, and had been indicted for the crime in Harris County. According to court documents, D.J. Weichert's wife, Jennifer, was seeing her husband off to work when Phillips showed up at their house. Jennifer reportedly asked what he was doing there.

Phillips allegedly said he was there because of the charges that had been filed and that he would spend 50 years in prison if convicted. Jennifer told police she saw the rifle in his hand and then they began arguing. Jennifer said that Phillips threatened to kill the family and while she pushed the two children back into the house, she heard at least one gunshot, maybe two.

Court documents then state Jennifer looked back and saw David Weichert slump and fall face down to the ground and then heard more gunshots and saw her husband D.J. lying on the ground with Phillips standing over her husband.

D.J.'s two children were taken to the sheriff's office for questioning. The children are currently with family members.

After the shooting, Phillips eluded police for 12 hours before surrendering peacefully. Phillips is currently being held on a $2 million bond for the two counts of capital murder he faces.

A memorial fund for the Weichert family has been set up at Citizens State Bank.
