Brazos County Jury Awards Injured Woman $2.16 Million

A 50-year-old woman seriously injured in an accident on August 5, 2008, in which a FedEx driver was proven to be at fault was awarded $2.16 million by a Brazos County civil jury on Friday.

Jeanette Stone's attorney, Fred Davis says on the day of the wreck, his client was on her way home from work when the FedEx driver, Joaquin Castro was heading south on FM 2818 and lost control of his vehicle during rainy weather and slammed into into Stone's SUV.

During the two week long trial in Brazos County's 361st District Court, the jury heard expert testimony stating that Castro's speed was about 55 miles per hour when the wreck occurred and that in addition to speed, rainy weather, slick road conditions plus poor tires were contributing factors to the crash that left Stone hurt.

The woman's injuries included the loss of her spleen, multiple broken bones and since the accident, Stone has had knee replacement surgery. The mother of several children is also unable to work and now lives with her parents.

Davis says his client tearfully thanked the jury for their work and is very grateful for the outcome of the trial.
