WASHINGTON COUNTY A Washington County jury found a Fayette County man guilty on charges of Super Aggravated Sexual Assault of a Child, Aggravated Sexual Assault of a Child and Possession of Child Pornography.
Benny Joseph Walker, 65, was found guilty in the 21st District Court in Washington County Tuesday. The jury returned a verdict just before 5 o'clock Tuesday evening. It took Judge Reva Towsley Corbett over an hour to read the verdicts out loud.
Walker was arrested on June 26, 2012, after two children made an outcry report. The children told investigators that Walker touched them inappropriately. The Washington County Sheriff's Office, along with the Texas Rangers and Scotty's House in Bryan, investigated the claims. According to investigators, Walker's home computer had child pornography on it when they took it.
Sexual Assault of a Child is considered “Aggravated” when the child victim is under the age of 14, and carries a punishment range of incarceration of 5 to 99 years or life. The offense is considered “Super Aggravated” when the child victim is under the age of 6, and carries a punishment range of 25 to 99 years or life. Each count of Child Pornography is a third degree felony carrying a punishment range of 2 to 10 years confinement.
Sentencing starts Wednesday morning. Prosecutors say it could last up to two days. Walker faces three life sentences and 1,250 years in prison.
