SAN ANGELO, Texas -- A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect's ranch.

The Third Court of Appeals in Austin ruled that the grounds for removing the children were "legally and factually insufficient" under Texas law.

Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to be grown-up predators.

The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings. The ruling came as judges were signing off on individual custody plans in San Angelo.

So, now what happens? I have to admit I am glad for the decision of the appellate court. I did not think it was right for them to take ALL of the children We're talking about breastfed infants and children taken away from their mothers because our government doesn't agree with their religion. At least this will keep the debate going and not give CPS the total control over families that they think they have

way to go judge...instead of trying to help these kids now,you want to continue to expose them to the dangers of child abuse, incest and neglect. In your mind you must feel it's cheaper to treat them when they become adults and are either in prison or a mental institution because of the abuse they were forced to endure as children.I hope your bleeding heart allows your pathetic mind to sleep well at night.

So much for protecting these kids. But it really shouldn't be a suprise when we let rapist out on low bonds. Tell me when are we as citizens going to take a stand against judges that are so willing to turn their backs on kids that obviously are in danger. They already have proof that several of these young girls have given birth to more than one child and they are only sixteens years old. This is a disgrace to the state as the courts once again turns their backs to protecting the young and innocent.

I guess its ok for kids in small ranches and cults to get abused and have sex at 12 with 60 year old men. Way to send a message judge! This judge was defiantly on one of these peoples magic spells to make such a decision.
