AUSTIN (AP) - The Texas Court of Criminal Appeals today agreed
to consider the contempt case of a lawyer facing 90 days in jail
for a lewd gesture he made in court in Austin.
The appeals court has ordered attorneys for Adam Reposa and
Travis County to file briefs by August 4th.
Reposa was found guilty of contempt April 15th for making a
gesture simulating masturbation at Judge Jan Breland during plea
negotiations in a driving while intoxicated case.
Reposa spent only about eight hours in jail before the Court of
Criminal Appeals ordered him released pending his appeal.
Attorneys for Reposa had said the sentence was excessive and the
finding of contempt erroneous.
